The legal landscape has changed dramatically since Ochieng’, Achach & Kaino Advocates was established, and so has the work of Litigation and Arbitration Department of the Firm. The enactment of the Constitution of Kenya 2010 heralded a new dawn of rights and freedoms in Kenya and a new system of political and socio-economic order. Initially, litigation as a practice area focused mainly on Criminal Law and Negligence, areas which remain distinguished and respected.
Kenya has however experienced major developments in the manner in which our courts work and with the new developments in the legal regime, the trend appears to be moving towards specialized tribunals established under various legislative regimes. Notable examples include the Public Procurement Review and Administrative Board, the National Environmental Tribunal, Industrial Property Tribunal, Business Premises Rent Tribunal among others. Drawing from this dynamism, Ochieng’, Achach & Kaino Advocates response to this has been swift, retaining its devotion to quality and timely delivery.
The new constitution and improving civic awareness has given rise to increased public law litigation of which Ochieng’, Achach & Kaino Advocates has played a central role. Our Litigation and Arbitration Department infuses its much boast of experience and continued learning to deliver excellent results in various disputes spanning the entire range of dispute resolution including Constitutional Law and Judicial Review, Tax Law, Procurement, Defamation Law, Banking and Finance, Tele-communications, Intellectual Property Law, Tax Law, Election Petitions, Energy and Construction Disputes among others.
